THE owner of a Hale Barns wedding venue has been convicted for failing to comply with a planning enforcement notice.


Mohammed Isaq, the owner of Davenport Green Hall, was convicted at Trafford Magistrates’ Court on December 17 after failing to remove an unauthorised marquee from his property.


He was bailed and will return to court on January 27, when he will be sentenced.


The court heard that Mr Isaq was first served with the enforcement notice in July 2010, requiring him to remove the unauthorised marquee and associated structures, used to host wedding and other functions.


The marquee has been located in the grounds of Davenport Green Hall, a listed building, since 2008.


Mr Isaq appealed against the first enforcement notice, which was considered at a four day public inquiry in April 2011, but his appeal was dismissed by a planning inspector in May 2011.


He then tried to challenge the inspector's decision in the High Court – that challenge was also dismissed in October 2011.


Mr Isaq then sought to challenge the High Court's decision in the Court of Appeal, however, this also failed in May 2012.


Trafford Council began the prosecution for failure to comply with the enforcement notice in February 2013.


Mr Isaq pleaded not guilty and sought to challenge the council's decision to bring the prosecution.


However, that challenge failed, and Mr Isaq has been convicted.
