A PERVERT who sexually assaulted a man as he lay unconscious has been spared prison over the incident.

Jack Brown indecently touched the victim during an incident in Warrington in December 2018, ‘targeting him in a vulnerable state’ after he had passed out due to alcohol consumption.

The 33-year-old, from Warrington but now of Birmingham, admitted sexual assault three days into a trial at Liverpool Crown Court shortly after the man he had attacked had given evidence as a witness.

A statement read out in court on the victim’s behalf on Friday, January 22, said: “What happened to me left me feeling lost and emotionless.

“My partner tells me I always look sad and I feel like I have no purpose in life.

“Before this, I always put other people first and gave up a lot of time to help people in need – now I have no motivation to do anything.

“I feel a cloud of judgement above my head.”

Judge Garrett Byrne instructed the jury to record not guilty verdicts on further counts of rape and assault by penetration after Brown’s plea was accepted by the Crown Prosecution Service.

The restaurant manager, who has no previous convictions, was handed a nine-month imprisonment suspended for 18 months.

Sentencing, judge Byrne said: “He was unconscious at the time of the incident due to drink, and you took advantage of his prone condition in order to satisfy your sexual desires.

“It’s abundantly clear that you have an unusual sexual predilection – you like to engage in sexual activity with unconscious men.

"This type of sexual activity is highly dangerous, not least to the victim.

"It opens you up to allegations of rape and sexual assault.

“You need to think very long and hard about what you do.

“However, given your guilty plea and good character, I’m able to suspend the inevitable prison sentence.”

Brown was also handed a notification requirement and a rehabilitation activity requirement of up to 15 days, as well as being told to pay a victim surcharge.
