A FLASHER who masturbated near a primary school in Stretford has been sentenced for the second time in four months.

Marcin Bialoskorski, of Spring Gardens, Salford, pleaded guilty to a charge of outraging public decency at a hearing at Manchester Magistrates' Court in March following the incident on November 27, 2019.

The 27-year-old Polish national was sentenced at Manchester Minshull Street Court today, Wednesday, and was also re-sentenced for a case in February in which he had exposed himself to five women, including a 15-year-old girl, between May 2019 and January this year.

Prosecuting, Duncan Wilcock, said: "On November 27 last year a witness who was working at a primary school in Stretford when she noticed this defendant looking towards the playground and appeared to be pacing up and down.

"She then said she noticed the same male sit down on a nearby bench and then witnessed the defendant put his hands down his trousers and began an action as if he was masturbating himself.

"She said she was approximately six to seven car lengths away when this was happening so she notified one of her colleagues to what she thought was happening.

"And then they organised for the children, who were playing outside – although it's right to say there's no suggestion that the children saw what was happening – inside the school.

"One of the teachers was notified and he came out and saw the defendant stand up and appeared to be shaking his hand vigorously towards the ground.

"He then adjusted his trousers and cycled off from the scene."

Police were called and officers noticed what appeared to be semen on leaves on the floor. Samples were collected and DNA analysis found they matching the defendant's.

During court discussions, Zoe Dawson, defending, said the defendant has already completed 40 hours of community work for his previous sentence before the lockdown.

Judge Angela Nield also recognised that Bialoskorski had paid for private psychotherapy sessions to help with his rehabilitation.

Judge Nield told him: "I have listened very carefully to what I been told about this matter which is aggravated by the fact that you were masturbating in public near to a school.

"However, it is not so different to the other offences which you were given a sentence in the community for me to find that any different sentence would have been imposed had all matters been before that judge earlier in the year.

"You have accepted that you were reckless in your action in respect of the proximity of that school and the sentence that he (the judge) imposed then was carefully framed as I would expect to address the risk that you present to the public of further offending.

"I have read the report of your progress on the order he made. It has been very good and you have engaged not only with probation but also have paid privately for sessions with a psychotherapist which again should assist in reducing the risk of your reoffending.

"You do not appear to have offended further since the time of imposition of that sentence.

"I will revoke the order that was made in respect of the other offences in February and will re-sentence you in respect of those offences and in respect of this matter.

"In doing so I have given you fully credit for your guilty plea in respect of this matter."

The defendant was given a three-year community order including 150 hours of unpaid work and 30 rehabilitation activity sessions.

He was also handed a five-year sexual harm prevention order and told to pay a surcharge fee.
