A MAN who drove away from an argument with his son failed a breathalyser after being stopped by police.
Blackburn magistrates heard Clifford Foulds had been sitting in his car waiting for his daughter to come home and let him in and until his son turned up had no intention of driving.
Foulds, 62, of Hamilton Street, Blackburn, pleaded guilty to driving with excess alcohol. He was fined £120 with £85 costs and £32 victim surcharge and banned from driving for 18 months.
Greg Earnshaw, defending, said Foulds had been out with his estranged wife and other family members. They went back to her house and an argument developed between Foulds and his adult son.
"He decided to go home to the house where he lived with his adult daughter but she wasn't in and he didn't have a key," said Mr Earnshaw.
"He was sitting in his car when his son pulled up alongside him and appeared to want to carry on the argument. He drove off and that was when he was breathalysed."
