A MAN who had part of his ear bitten off in a nightclub brawl refused to lodge a complaint with police.

Blackburn magistrates heard Gary Davenport was covered in blood when police came across him in Accrington town centre in the early hours of the morning.

They were then told he had been ejected from a nightclub after causing trouble and advised him to go home.

Davenport became abusive and when he was told he was being arrested for being drunk and disorderly he struggled violently and threatened to kill the officers.

Davenport, 36, of Bridge View Gardens, Darwen, pleaded guilty to being drunk and disorderly and assaulting an emergency worker. He was made subject to a community order for 12 months with 10 days rehabilitation activity requirement. He was made subject to a curfew from 9 pm to 6 am for four months and ordered to pay £75 compensation, £85 costs and £90 victim surcharge.

Jonathan Taylor, defending, said Davenport was hurt but accepted he should not have taken his frustrations out on the officers.

He said his client had been in a nightclub when a group of men tried to get him involved in trouble. They wouldn't let him leave and when he stood up for himself he was attacked and part of his ear was bitten off.

"He was also punched repeatedly before he was thrown out," said Mr Taylor.

"He accepts that when he was outside he should have heeded the advice of the police. He knows they have a hard enough job to do.

"They tried to be fair and reasonable with him but he didn't heed the warning."
