NOTICE OF CONFIRMATION OF PUBLIC PATH DIVERSION ORDER TOWN AND COUNTRY PLANNING ACT 1990 SECTION 257 THE CHESHIRE WEST AND CHESTER BOROUGH COUNCIL
(PUBLIC FOOTPATH NO. 11 (PART) IN THE PARISH OF FOULK STAPLEFORD) PUBLIC PATH DIVERSION ORDER 2020
On 19 January 2021 the Cheshire West and Chester Borough Council confirmed the above order. The effect of the order will be to divert that length of Public Footpath No 11 in the Parish of Foulk Stapleford commencing on the existing footpath at the junction with the termination of Old Hall Lane (UX1103) at OSGR SJ 47997 62304 then running in a generally northerly direction for a distance of approximately 652 metres to a point on the existing footpath at OSGR SJ 47664 62841 on to a line commencing on the existing footpath at the junction with the termination of Old Hall Lane (UX1103) at OSGR SJ 47997 62304 then turning west south westerly crossing a ditch byway of a footbridge then westerly for approximately 108.2 metres to OSGR SJ 47891 62291 then running in a generally north westerly direction for approximately 72.7 metres to OSGR SJ 47836 62338 then running in generally north easterly direction for approximately 27.9 metres to OSGR SJ 4785 6235 crossing Guylene brook by way of a footbridge and running in a generally north west northerly direction on the east side of the brook for approximately 545.8 metres to a point on the existing footpath at OSGR SJ 47664 62841

The order came into force on the 18 March 2021 when Cheshire West and Chester Borough Council certified that the terms of Article 2 of the order have been complied with but if any person aggrieved by the order desires to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the above Act or on the ground that any requirement of the Act, as amended, or of any regulation made under it has not been complied with in relation to the confirmation of the order, he or she may apply to the High Court for any of these purposes under section 287 of the Town and Country Planning Act 1990 within 6 weeks from the date on which notice is first published as required by paragraph 7 of schedule 14 to the Act
